These Terms of Service (“Terms”) are an agreement between you and ABC Unite governing your use of our website, account portals, consultations, communications, bookings, and programs. Please read them carefully.
Eligibility and acceptance
By accessing the website, creating an account, booking a consultation or program, or otherwise using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
You must be at least 18 years old and legally capable of entering a contract to create a caregiver or coach account. If you act for a participant, organization, or another person, you confirm that you have authority to do so and to provide the information submitted.
Services and care limitations
ABC Unite provides coaching, community participation, life-skills, social-skills, job-readiness, caregiver-support, and related programs. Availability, content, staffing, locations, schedules, and participant fit may change.
ABC Unite is not an emergency service. If someone is in immediate danger or experiencing an emergency, call 911 or the appropriate local emergency service. Unless expressly stated in a separate written agreement, our services are not medical care, psychotherapy, crisis care, or a substitute for advice from a regulated health professional.
Assessments, goals, observations, and progress information are used to guide ABC Unite services and do not guarantee a particular clinical, educational, behavioural, employment, or developmental outcome.
Accounts and participant profiles
You must provide accurate, current information and keep login credentials confidential. You are responsible for activity under your account and for promptly telling us about suspected unauthorized access.
Caregivers are responsible for maintaining accurate participant information, disclosing information reasonably necessary for safe participation, and ensuring ABC Unite has current emergency and authorized-contact details. Student or participant access credentials must be shared only with the intended user and supervising caregiver.
We may reject, suspend, or close an account when reasonably necessary to protect participants, staff, the service, or others; investigate misuse; comply with law; or enforce these Terms.
Bookings, fees, and payments
Current fees and the services included will be shown before purchase or confirmed in writing. You authorize ABC Unite and its payment processor to charge the selected payment method for amounts you approve, including applicable taxes. Payment-card processing is handled by Stripe and may also be subject to Stripe's terms.
Booking, cancellation, missed-session, refund, credit, and rescheduling rules presented at checkout, in a program description, or in a signed service agreement form part of these Terms. Where no specific rule is stated, contact us before cancelling; refunds or credits are not guaranteed after a service has been delivered or costs have been committed.
You are responsible for accurate billing information and any lawful chargeback or collection costs arising from an overdue or improperly disputed amount. ABC Unite may correct pricing errors or cancel an affected transaction and issue any required refund.
Participation, safety, and conduct
Participants and accompanying persons must follow reasonable safety directions, venue rules, program expectations, and staff instructions. Treat participants, families, coaches, staff, and community members respectfully. Harassment, threats, discrimination, violence, unsafe conduct, unlawful activity, unauthorized recording, and disclosure of another person's private information are prohibited.
Caregivers must disclose relevant allergies, medical or behavioural safety concerns, accessibility needs, and changes that could affect safe participation. In an urgent situation, ABC Unite may contact emergency services and the participant's emergency contact. We may modify or stop participation when reasonably necessary for safety or when a program cannot appropriately meet a participant's needs.
Communications and electronic records
You agree that account notices, booking confirmations, agreements, receipts, and service communications may be delivered electronically. Keep your contact details current. Promotional messages may be unsubscribed from at any time, though necessary service messages may continue.
Electronic signatures and records may be used where permitted by law. Messages and uploaded materials must relate to ABC Unite services and must not contain malicious code, unlawful content, or information you lack authority to share.
Website and content rights
The website, branding, program materials, text, graphics, software, and other ABC Unite content are owned by ABC Unite or its licensors and protected by applicable intellectual-property laws. We grant you a limited, personal, revocable, non-transferable right to use the service for its intended purpose.
You may not copy, sell, scrape, reverse engineer, disrupt, or commercially exploit the service or content without written permission. You retain ownership of content you submit and grant ABC Unite permission to host, use, reproduce, and share it only as reasonably necessary to provide, secure, and administer the services.
Third-party services and links
The service may rely on or link to third parties, including payment, authentication, email, video-meeting, mapping, or venue providers. Their services are governed by their own terms and privacy practices. ABC Unite is not responsible for third-party websites or services outside our reasonable control.
Disclaimers and limitation of liability
To the extent permitted by law, the website and services are provided “as is” and “as available.” We do not promise uninterrupted access, error-free operation, or that every program will be suitable for every participant.
To the extent permitted by law, ABC Unite and its directors, staff, coaches, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, revenue, opportunity, or goodwill arising from the services. ABC Unite's aggregate liability arising from a claim will not exceed the amount you paid ABC Unite for the service giving rise to the claim during the six months before the event.
Nothing in these Terms excludes liability or rights that cannot lawfully be excluded or limited, including applicable consumer-protection rights.
Termination and changes
You may stop using the service at any time and may request account closure, subject to outstanding payments and records we must retain. Provisions that by their nature should survive termination—including payment obligations, ownership, disclaimers, liability limits, and dispute terms—will survive.
We may update these Terms to reflect service or legal changes. Updated Terms will be posted with a revised date. For material changes, we may provide additional notice. Continued use after the effective date constitutes acceptance where permitted by law.
Governing law and contact
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, disputes will be brought before the courts located in Ontario.
If part of these Terms is unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, any booking terms, and any signed service agreement form the agreement between you and ABC Unite for the applicable services. If a signed agreement conflicts with these Terms, the signed agreement controls for that conflict.
